In 2008, under the direction of Ben Klemens, ESP produced the 2008 State of Software Patents which highlights that non-software companies are now often victims of software patent litigation, and that the cost of software patent litigation to USA companies can be estimated at $11.26 billion per year. ESP also submitted an amicus curiae brief to the CAFC for the in re Bilski case: esp-bilski-final.pdf

In 2009, under the direction of Ciarán O'Riordan, ESP launched the swpat.org wiki and submitted an amicus curiae brief to the US Supreme Court for the Bilski v. Kappos case: amicus-bilski-2009
